Exclusionary Rule Essay

Constitutional Law pertains to the account of fundamental laws of nation-states and other political associations. Thus, constitutions refer to the foundation and structure for government and could limit or characterize the power and system of political institutions to carry out new laws and policies (Chemerinsky, 2003). The constitution sets the boundaries of new laws, thus, the entire state is subjected to the constitution. The Fourteenth amendment of the United States which covers citizenship and civil rights is where the Fourth Amendment sprouted from. In recognition of equality among citizens discarding race, ethnicity and religion, the fourth amendment was made to protect the rights of the citizens and those are the right to due process and to privacy and security of his properties. This fourth amendment was created in 1914 was at the federal level and was only adapted by all states of America. The Fourth Amendment of the United States Constitution (Search and Seizure) includes the Exclusionary Rule which protects citizens of the United States from illegal searches of their private properties (Sundberg). Any unwarranted intrusions made by the police force to the privacy of an individual are prohibited by law. For a search to be valid the warrant to search should be able to describe in detail the items to be searched, the location and facilities to be confiscated (Roberts, 2007). This lets the people enjoy their right to feel secure of their houses, documents, papers and other properties that are considered private. The rule also gives the citizen a right to due process as the police force cannot just confiscate and search them without the needed papers. Furthermore, this law also abides by the philosophy of deontology wherein the action is judged to be right or wrong if the root of the action itself is based upon the duty and obligation of a person (Darwall, 12). Thus, the means upon which evidence is acquired is more important than the value of the evidence gathered. Since this rule encompass criminal cases only, even if the police found a gun or any evidence that points out that the man who owns the property upon which the evidence was found is indeed the perpetrator, this evidence will be considered invalid in court and will not make any impact on the courts decision given that the police did not have the warrant to search the individuals property. In addition to that, a search that is made in areas that is not specified by the warrant is not allowed even if evidences are found within the parameters of the facility that was searched. The positive side of this law is that it protects the rights of every citizen against illegal searches by the police, thus securing their privacy. This also discourages illegal searches and bounds the police to their duty by following the law. However, the downside of this rule is that if evidence is found in illegally searched areas, even if it can very well summarize the outcome of the case will be put to waste for the simple reason that there was no warrant of arrest or it was not indicated in the warrant that such place is included in the search. The absence of that piece of paper means a lot in the proceedings, and such important evidences are discarded. For example, a weapon that is found in the car of a murderer with his finger print on it would still be useless in court since it was searched illegally. Which is more important then, the evidence or how the evidence was obtained? Perhaps for us to fully assess the situation it is a need for us to analyze a certain scenario. For the purpose of further understanding the gravity of the situation let us assume that a bomb explosion took place in a residential neighborhood rendering 10 people killed and 20 other wounded. Right after the explosion operatives responded in just 3 minutes given that the place is in close proximity to the police station. The initial assumption was for it to be a terroristic act. Since the neighborhood was closely knit almost everyone knew something about everybody. They denied that such ruthless murderer could be one of their residents but a policeman guided by his instinct was convinced that a prominent resident of the neighborhood did the bombing. The resident was bound to leave the place the day after but since it was a Sunday, the court was close and cannot issue a warrant plus the fact that they cannot link him to the bomb explosion. The policemen decided to search the house of the resident without the warrant and found evidence. Materials of making a bomb were found at his residence. They arrested him but after years the case was dismissed because of the exclusion rule. First and foremost, there was no warrant and second they filed motion to suppress the evidence. The law supports the defendants claim and sets him free. This issue is a philosophical debate of the deontological and consequentialist groups (Philip, 2002). Deontological perspective would argue that the fault was in the part of the officials since they did not do their duty. To act from duty is to do the right thing and it is more important that catching the perpetrator before he leaves the town. The obedience of duty is placed in higher value as the result of their act. Even if they found the evidence and arrested the man responsible for the bombing that killed 10 people, it is still not valid. They did not abide to their duty. â€Å"A human action is morally good if and only if it is done from duty† (Kant, 397–399). Consequential or Utilitarianism would say that the act of searching without a warrant is the right thing to do since they found who did the bombing. The measures upon which the police undertook to get to the perpetrator is not important as long as the greater good for the most number of people was realized, and that is justice. It does not matter if there is no warrant and the police invaded the house of a private citizen as long as the truth was discovered and the person responsible was caught. The evidence was clear, therefore is compensates for the policeman’s inability to adhere to the Fourth Amendment. Both philosophies have their reasons that are enough to justify their claims, but I believe that we should keep the Fourth Amendment as it is. It is in our law that we should respect the privacy and rights of a citizen. In the scenario above the policemen caught the perpetrator because they found evidence in his household. The search was illegal but either way, they got what they were looking for. However, what if they saw nothing, would it not be invasion of privacy on grounds as weak as instinct? Then the basic right to privacy and security of the citizen would have been violated. There is no need to change the exclusionary rule, policemen should abide by their duty and help to protect the rights of the people. We cannot compromise the basic rights of an individual for public safety. Though it is the duty of the police to go after the perpetrator and give justice to the crimes he has committed, he also has rights whether he is a citizen of the United States or not. According to the fourth amendment the exclusionary rule covers even illegal aliens. We cannot strip a person with his rights even if the need arises for the simple reason that it is adherence to our duty that defines who we are. If the exclusionary rule is to be abolished then, warrantless arrests and rampant would be more prevalent in our nation. Even now that the rule takes effect there are still violations. Rampant searches especially to our brothers with colors are evident in our nation. Wire tapping is also an issue about the security of communication lines especially for public officials. The Bush administration wanted to allow the use of evidences that were illegally seized by the police given that it was in good faith and is useful in finding the person who is responsible for the crime. Plus they want to allow federal agents to arrest persons without a warrant of arrest regardless of nationality as long as it is done with the most honest intentions. Sure this can solves some crimes such as the scenario given above, but I want to point out that this only allows further suppression of a persons liberty. When the use of illegally searched evidences is allowed in court, this would only encourage the policeman to search anyone and any house or establishment that they want to search and if they find nothing, the person concerned can’t go after the policemen and ask for damages. They will be protected by law to barge into the homes of countless citizens and invade their privacy. If we take action just because we believe that it is for the best even if it is not in our duty, we have no guarantee that that action can be fruitful. It can’t be denied that there is a need to reduce crime in our nation and solve those that are still looking for justice, but giving justice for the price of a person’s liberty is a cost that’s too high for a nation who values autonomy of its citizens. The exclusionary rule has set standards for our policemen for them to abide too such that their level of professionalism and adherence to their duty is further raised higher. They are bounded by law to protect the citizens of this nation and they should do so while safeguarding the basic rights of every individual. Burt’s bee is an American company that deals into personal care products. It has differentiated its self on the basis of ‘Earth Friendly, Natural Personal Care Company’. Their products are being made from beeswax, natural oils, herbs and minerals (Smith, Dulcinea Norton, 2008, March). This company begun its operations in the year 1984 when Roxanne Quimby and Burt Shavitz an ex-couple living in Maine started making candles. They were made from they by-product of beeswax obtained from Burt’s honey business. This invention made sale up to $20,000 by the end of first year. Soon they product earned recognition and got orders form a boutique in New York. They added many organic beauty products to expend this line. In the year 1991 they added their best seller product lip balm. Soon they discontinued their famous candle production and concentrated on personal care items. Currently their product line includes face, body, men’s grooming, baby care, hair, lip care and outdoor remedies product. Their products are being sold in different countries of the world including United States, United Kingdoms, Canada, Ireland, Hong Kong and Taiwan. Retail Experiment Burt’s bee distinguished itself on the basis of organic and eco friendly products. It created a niche for it’s product by targeting people who are more inclined towards purchasing and using less chemical oriented products. Retail business can be explained as sale of goods or merchandises directly to customers through a fixed point. Availability of logistics and expansion plans play a vital role in deciding either a company should move into retail business or not. When a profit bearing company like Burt’s Bee plans to expand its operation they have to make an appearance in shelves of different departmental stores, malls, grocery stores even drug stores to be more visible over other competitor products. Making such strong appearance is not possible by limiting it’s self to being a manufacturer and a direct seller. Looking at online shopping websites (which is also a part of retail business) it brings products at a click of one button. It also saves human resource and middle man profit. It gives endless shelf-space to a manufacturer to display its products. Burt’s bee was already selling their product through QVC and making handsome amount of profit on it. It was time to get into physical retail business to increase their profitability. Retail business has many different advantages. If one person is out to buy grocery for home might also want to purchase any product that he sees on shelves. We all try to experiment with new products. This experimental nature is at peek when we go out of the house to do a week’s shopping. Instead of going at one particular shop to buy a specific product we all prefer one place stop that has all the products. It’s an era of expediency and we enjoy taking advantage of it. Retail business aids in saving time for a lot of customers. People are so busy in their personal and professional lives they prefer buying all what they need from one places rather than visiting different shops for specific products. Retail business also gives an edge over all those strong products available only at their dedicated shops. Their presences can be easily overlapped with a product that is available at every nook and corner. People usually go out with friends to malls for shopping. Strong word of mouth can also play a heavy role in increasing sales. Burt’s bee has a reputable name in the market and a loyal set of customers. Changing brand habit should not be a difficult task for them once the presence of their product becomes prominent. Appearance of Roxxane Quimby at different retail shops once in a while will add to customer satisfaction. When she started the business by selling beeswax candle she realized that most of her customers looked at the bottom of it to check its finishing. Costumers are very particular about quality maintenance. Heavy marketing can attract more customers to meet the proud owner of the product they are using. The fear of being discontinued from the end users can also be minimized through this strategy. This can also be done through comment cards. People can fill them and send it to her to give her. Retail business enables a customer to compare products at the location. This comparison can be made on the basis of ingredients, prices and packaging. Burt’s bee has the competitive advantage of being organic and less chemically treated product over others. It has gain popularity for being made from natural oils unlike other products available in the market. Conclusion Thus opting for a retail business will help them achieve desired target in a given time period. It becomes difficult to be a direct seller and expend to different countries. Though sales and revenues increase can not be separated from good marketing campaign. Promotion incentives like free samples can also be used to help purchase of new products and attract more customers. Heavy ATL (Above The Line) and BTL (Below The Line) marketing can also increase product awareness and spread the brand name amongst non users. Product availability will have a proportionate effect on increase sales. With higher demand price can also be increased. People are ready to pay a high amount but do not believe in compromising in quality. They will always choose convenience of purchasing ten things from one shop then roaming around 10 shops to buy one thing.

Also I do recall dreaming of a huge mansion on top of a hill which was lavishly decorated. Sludge Lab Report Essay For the first physical observation, I tried smelling the mixture. It smelled like permanent marker. Next I tried sticking a spoon in it and stirring the tan solid lightly. It looked like it was an extremely smooth sand. Finally, I tried drinking the liquid. Nah, I’m kidding! To start off, I will describe the liquid. I separated it simply by using the decanting technique. I carefully poured it off of the mixture of solids and into a separate plastic cup. Easy. The physical property of phase was used for separation. It was the only liquid in the mixture. Then I had to identify it. I smelled it and it had a permanent marker smell to it. That led me to believe it was an alcohol. Next, I tried measuring the density using a graduated cylinder and a balance. I measured the amount of alcohol I put in the graduated cylinder (volume) and how many grams it was on the balance (mass). The volume was 9. 2cm3, the mass was 7. 25g, and the overall density was . 79cm3. That proved my liquid was not water. Finally, I tested the boiling point to determine what type of alcohol it was. I used a ring stand, thermometer, hot plate, test tube, and a beaker full of water. I placed the beaker full of water on the hot plate. I then filled the test tube with my liquid and attached it to the ring stand. Finally, I put the thermometer in the test tube and turned the hot plate on high. The liquid really started boiling around 78 degrees (Celsius), so I concluded that my alcohol was ethyl alcohol. Next we have the blackish/brownish particle layer. To separate it, I used the magnetic retrieval technique. This tests the physical property of magnetism. I simply used a magnet to retrieve the particles and a toothbrush to remove them from the magnet into a separate paper cup. There’s only one substance that is magnetic, but I had to do two more tests. I simply checked solubility in water in alcohol. It wasn’t soluble in either. It was, obviously, iron filings. The third substance I decided to separate from the mixture was the tan sand. After the liquid was removed, the solid wasn’t as silky and it was more like normal sand. I also discovered the â€Å"rocks† were actually clumps of this substance. ANOTHER thing I discovered was white/clear grains. Yes, it was a salt! That means there’s only one way to separate this stuff: dissolve and filter. I poured water onto the rest of the mixture and stirred it up for a solid minute or so. After that, I poured the water into a funnel lined with filter paper which dripped down into another cup. This left me with only the tan sand. First I tried smelling it. It had a REALLY strong smell. Secondly, I recalled it being in the alcohol with a few particles floating around. This got me to believe it was slightly soluble in alcohol. Finally, I tried testing solubility in water. It just floated at the top without any particles floating around in the water, so it wasn’t soluble in water. Due to these factors, I determined it was sulfur. Last, but certainly not least, the white/clear grains. Before I evaporated the water, I took note that it’s soluble in water. To separate it from the water, I evaporated it off. I simply put it on a hot plate, set it on high, and poof. Only grains. By now I identified it as a salt. My next test was alcohol solubility. Turns out, it’s only slightly because the alcohol was very cloudy after the dissolving process. Lastly, I put a sample on a watch glass with some water and left it out over night to check crystal shape. In the end, the crystals were spear shaped, leading me to the conclusion that it was potassium nitrate. All in all, my sludge consisted of ethyl alcohol, iron filings, sulfur, and potassium nitrate. I think my only difficulty was that I discovered the salt fairly late in the process. Overall, I enjoyed this lab because I really felt like I was doing something a real scientist would do. (Juice Report p. 19) Chapter 3 Challenges The principal challenge of the Spanish market is first of all that there are already many companies on the juice market. Innocent offers only a niche product with a relatively high price which could be difficult as a high unemployment rate and an unequal income is characteristically for the country. Furthermore the potential consumers are spread in the country side and in contrast to that a bigger concentration with people live around the big cities. Product: Innocent should think about if they have to adapt their products. It may be that the Spanish people have a different taste. The product labels need to be in Spanish. Great Political Leaders of the Twentieth Century The history of the 20th century can be defined by the biographies of six men: Franklin Delano Roosevelt, Winston Churchill, Vladimir Lenin, Adolf Hitler, Mao Tse Tung, and Josef Stalin. Each of these men had a lasting significant involvement in world affairs. This essay will focus on the significance each individual had on the ideologies of Democracy and Totalitarianism. Four of the six individuals were leaders of a totalitarianistic state, and three of these led a communist country. Also four of the six leaders were in power during the Second World War. The profiles of these six men formed the world that we live in today. Vladimir Illich Lenin was the first individual to put Marxist ideologies to work. In April 1917 Lenin returned to Russia from his exile in Switzerland to give his 'April Theses.' It was here that Lenin outlined how his revolution was to take place, the Bolshevik Revolution began on November 6 1917. Within a week the Bolsheviks were in control of most of European Russia, and immediately Lenin ordered that the Russians abandon the war against Germany. After abandoning her allies in World War One the Russians were hurled into a civil war. It is here that we first see the ideologies of Totalitarianism and Democracy clash. The democracies of Britain, France, and the United States all sent troops to Russia in the support of the 'Whites,' or enemies of the Bolsheviks. Lenin took the poor country of Russia and turned it into the Union of Soviet Socialist Republics or U.S.S.R. Through his policies of War Communism and its replacement the NEP Lenin was able to stand the newly formed U.S.S.R. o n its own two feet. One of Lenin's ideas was 'International Socialism,' it was under this idea that he set up the Comintern with the purpose of spreading communism throughout the world. His successor, Josef Stalin took a different approach in his ideas of 'Socialism in one country." Josef Stalin led the U.S.S.R. from the death of Lenin to his own in 1953. Stalin led the Soviets through the betrayal of the Germans in the Nazi-Soviet Pact, he turned back the Nazis on the Eastern front, and brought the U.S.S.R. out of the Second World War as one of the only two superpowers in the world.
